Quel rôle pour l’audience de plaidoiries en procédure écrite ?

In this article, Senior Associate Lena Hoss, together with the President of the Luxembourg Supreme Court, M. Thierry Hoscheit, discuss the continuing role of oral hearings in written proceedings, in the context of recent reforms in Luxembourg making such hearings optional in most written civil and cassation cases. The authors note that oral pleadings remain important particularly in complex cases, as they may help clarify key issues, address potential misunderstandings, and support confidence in the justice system. Comparing Luxembourg with France, they suggest that hearings are most valuable when all parties, including the judges, are well prepared, the scope of oral argument is defined in advance, and the process is used as a practical tool complementary to written submissions rather than as a repetition of them.
