Elvinger Hoss Prussen secures victory in a trademark law dispute before the General Court of the European Union

Mostostal Siedlce sp. Z o.o., a leading European manufacturer of steel structures, requested the revocation of a European Union trademark for lack of genuine use for certain goods and services covered by its specification. The initial positive decision of the European Intellectual Property Office (EUIPO) is now confirmed in the context of the appeal brought by the opposing party before the General Court. 

The team, composed of partner Katrien Veranneman (EU law), counsel Emmanuèle de Dampierre (trademark law), and associate Paola Cardile, successfully argued a series of procedural and substantive points in support of the EUIPO, validated by the General Court in a detailed judgment (T-663/24 – Mostostal v EUIPO – Mostostal Siedlce, 11 March 2026).
