Partner Florence Apostolou and Senior Associate Christiana Goula have written the Luxembourg chapter of the International Employment Lawyer's (IEL) Guide to Restrictive Covenants. The Guide provides a comprehensive overview of the legal framework governing restrictive covenants in employment across 25 countries worldwide, covering key issues from enforceability requirements and different types of restrictions to post-termination obligations, employer enforcement procedures, remedies and cross-border considerations.
Luxembourg takes a cautious and employee-protective approach to restrictive covenants, with enforceability depending largely on proportionality, the employer’s legitimate interests and the employee’s role. While confidentiality, non-solicitation and limited non-compete provisions are used in practice, post-termination restrictions are scrutinised carefully and broader restraints are more likely to be upheld only where they are narrowly drafted and well justified.
